Opinion

Hillary Clinton won the 2016 presidential popular voting by 2.86 million.  So the people of the United States decided to install that women into being the president of the United States by any competent measure.  But, the retarded, incompetent, flawed, pro fascist, idiotic, despicable electoral college was allowed to change the votes of the American public.  This was a crime against the people.  Members of the electoral college should be punished for their action against the will of the people.  Anyone who supports this existing crap system is a moron or idiot – you choose which.

We need to eliminate the electoral college NOW!

What the electoral college accomplished as a result of their perceived incompetence:

  • Create a more divided country.
  • Put in place an alleged corrupt politician who may well be a criminal.
  • Revealed to the world how the Republican Party is moving away from Democracy and toward fascism.
  • Exposed the number of Republican politicians who failed to hold to personal high standards but instead  followed a cult leader who lacked proper standards to lead this country.
  • More, much, more.

There are a couple of legal principles that are to be considered by the United States Congress as guidelines when they make legislation for making a government agency and composing the extent that the agency is allowed to function.

You can view in you mind a government agency being created much like any business.  The business is created by congress but the conduct of that business has been told what is is intended to work toward and hopefully achieve positive outcomes for the people of the country, some positive result.  This business type purpose does have limits as to what it can function and how it can function by congress.      Government agencies do not sell products but instead offer services to the whole nation of civilians in separate, specific areas, as specified by congress.  A list of government agencies is very large, a quite complex.  The agencies offer mainly service of instruction, regulation, police, enforcement, research and more.

The supreme court appears to think that one of their areas of concern is to perform oversight, to regulate agencies and see if they overstep their mission specified by congress.  You would think that Congress should police it’s own government agencies.

The supreme court has a number of problems facing achieving a positive reputation.

A problem at the root of the current supreme court operation is how the supreme court judges were placed into their positions.  We need judges that understand and work toward resolving the concerns of all the American public not working for a special interest person or group.

The appointment of some current supreme court justices appears to be flawed which may be at the root of it’s problems.  Some of the problems:

  1. None of the judges were voted in by the American public thus lacking an appointment value.
  2. Four of the eight justices currently serving on the Supreme Court were nominated by presidents who lost the popular vote in their first term.  These justices are thus lacking some credibility in their appointments.  This is just one example of a flawed political practice.  The American voting public must have binding responsibility for all appointments when they are made through an intermediary politician.
  3. There has been a couple of outside special interest groups that have tried to manipulate the decisions that the court renders.  One individual who has been quite successful in making supreme court recommendations is Leonard Leo who has worked hard to push forward justices to his liking.

“Leo leads the conservative legal organization the Federalist Society, through which he has spent the majority of his adult life getting conservatives appointed to the most powerful courts in this country, including the Supreme Court.”

  4.  There is a couple of legal issues where the Supreme Court thinks it has jurisdiction over any government agencies.  It seems that the supreme court is concerned that an agency does not go beyond the specified limits set by congress.  This is now a convenient excuse for the court to expand its power.

Where does the court come up with the approach to dig deeply into agencies operations to see if they go beyond what Congress specifies them to achieve?

Major questions doctrine

Congress must have clearly authorized agencies to regulate issues the Court considers to be of vast significance.

Non Délégation Doctrine

The non–delegation doctrine is a principle in administrative law that Congress cannot delegate its legislative powers to other entities.

This then becomes a convenient excuse for the Supreme Court to regulate a government agency’s policies if it can cite that that agency has gone beyond what Congress has told it to accomplish.  It seems the current ambition of the court is to deconstruct the administrative state which is really stupid at the operation level.  An example of this is  that the administrative states like the EPA has a very large research body of workers that help devise good climate change response regulations.  The courts can not expect to have this capability and thus must allow agencies to devise their own regulations.

This then can become a contentious situation when any agency regulates any business that is extremely wealthy and powerful. Citizens who possess special interest power with political groups, politicians and Supreme Court judges might apply their control over how the court intercedes.  It appears to many that this is the current situation where the fossil fuel industry is fighting to maintain its market.

There is also a special interest group, Federalist Society that believes in interpreting the constitution as written, not improving upon it in any way.

“… the province and duty of the judiciary to say what the law is, not what it should be.”

Originalism is one of the pillars of The Federalist Society, meaning that members believe the Constitution must be interpreted as the founding fathers intended at the time it was written—and that they don’t intend or see fit to use the document to protect the rights of women, people of color, LGBT people and other individuals from communities who were not represented from the room where it was written, and in some cases were even seen as the legal property of its framers.

A nearly total separate issue is when the Supreme Court made a decision that has imperiled our system of Democracy.

On Jan. 21, 2010, in the case Citizens United v. Federal Election Commission (FEC), the Court ruled to strike down a prohibition on corporate independent expenditures, which has since enabled corporations and other outside groups to engage in unlimited amounts of campaign spending.  This is probably the most important element for allowing the plutocracy group to rule the United States instead of having a true form of Democracy.

Summary:

The implication here is that the majority of the Supreme Court justices seem to be supporting businesses that are attacking our climate and women’s rights because they claim some government agencies have gone beyond what the Supreme Court sees what Congress has told them to do.

How convenient for some industries and ultra conservatives to see the Supreme Court working for them and against climate change and women’s rights with some thin excuse.

Thus, some justices appear to have become corrupt by catering to a few powerful groups and seemingly stupid toward realizing their duty to what is correct for women, people of color, LGBT people and our future survival for all humans.

The current group of justices support the rule of the plutocrats over the rule of the citizens, an act of near criminality.

The United States May Be Sliding Into Being A Dictatorship

The United States May Be Sliding Into Being A Dictatorship

06/12/2022 Score Card Comments 0 Comment

The USA is destined to be autocratic according to a number of reputable sources.  Let’s show you a partial list of these predictions:

Warning signs:

  • “US could be under rightwing dictator by 2030, Canadian professor warns”
  • “Can Canada withstand the U.S. slide to fascism?”
  • “Opinion:  Trump would make America a dictatorship”
  • “TRUMP MAKES IT CLEAR HE’D BE AN OUT AND OUT DICTATOR IF REELECTED IN 2024”
  • “WHY THE NEXT REPUBLICAN PRESIDENT CAN BECOME A DICTATOR IF TRUMP IS NOT PROSECUTED FOR HIS CRIMES”

How, in the past, have democracies changed into being authoritarian?  Why does this happen?  Let us examine a few past methods used to overthrow a democracy.

Political Radicalization and Social Desperation

  • “One way is the result of political polarization, where the competing political sides no longer want to cooperate with one another, allowing violent or extremist groups to take over politics instead.”

Dissatisfied Elites

  •  “A democracy can also fall when a country’s elites feel that democracy no longer “works” for them.”
  • “In some cases, democracies fall into dictatorships when “elites” (that is to say, people in important positions in society such as political leadership, business, finance, religion, or the military) feel that the democratic system no longer “works” for them; the system is at odds with their financial or political interests.”

Apathetic and Alienated Voters

  • “Democracies can also fall into dictatorships when voters become politically apathetic, thereby withdrawing themselves from participation in the political process. This is a growing problem in many democracies, as indicated by falling voter turnouts across much of the democratic world.”

Methods for creating voter apathy by the United States Republican Party:

  • 1). Voter suppression.  Currently being done in United States red or heavily Republican states.
  • 2)  Encroachments onto free speech.

 Summary:

So much of the United States institutions and the voting public have put up with despicable actions from politicians, special interest groups, wealthy donors, mass media outlets, TV hosts, etc.  There has been sort of a collective trend of deplorable actions that has resulted in a gradual shift of general public expected norms away from democratic norms but now a belief that authoritarian  rule might make for a better living environment.  Part of this attraction to authoritarianism is it looks to be way more simple.  Democracy as practiced in the United States can look to be complex and messy and some times ruled by special interests and not for the best interest of the whole public.

A Front Door Lock Check Is Important

A Front Door Lock Check Is Important

For years, when I leave my house after locking the front door, I turn the outside front door to make sure that the door is locked.  I have a habit of turning the knob back and forth a number of times probably to make sure the door is really locked.  A few months ago I sort of noticed that I forgot to lock the door because it would open after turning the outside door knob a few times.  I was very much wrong.  I had NOT forgotten to lock the door.  I finally discovered that turning the outside front door knob after locking the door would unlock the door!  YIKES!

Watch the “Outside Door Knob” to see this happen:

Watch in the next video “Faulty Front Door Lock“ what takes place with the inside door lock.  As the outside door lock handle is rotated back and forth the inside lock moves slowly to unlock the door.

My wife told me that she thinks our front door lock is twenty years old.  I called a locksmith immediately to have that front door lock replaced.  The locksmith told me that this problem can happen as the door lock ages with corrosion.

A long time ago, I came into contact with an older women fitness trainer at a local gym that I attended.  I never use trainers but we had just a few casual conversations at the gym. She specialized in helping the older clients.   I only had a very casual acquaintance with her.  I left the fitness club a long time ago.  About a year ago I met her at the same post office I use and she invited me to join her for coffee at a place across the street.  She then called me whenever she went to the post office to pick up her mail and we would go to the same place for coffee.  I found out that she was homeless but was fortunate enough to be taken in at a home for older women.  I found out that she paid about $6 to have a bus take her to the post office.  I then insisted that I pick her up at her house.   Then I discovered that she was facing problems.  She seemed to have some sort of mental problem, possibly dementia.  She had difficulty hearing.  I frequently had to take louder and repeat myself.  I took her to the store where she would get her hearing aid repaired but her hearing aid never seemed to work properly.  The home where she was allowed to stay evidently had requirements that each women attend periodic doctor appointments.  My friend failed to remember her doctor appointments so her shelter house told her that she was about to be kicked out of the house!  She would be homeless.  I could not believe that they would do this to her.  She has family in Texas and they had a house that her father gave to his children.  Two of her siblings lived in that house and now they invited her to join them.  So it was decided that she should travel back to Texas.  I had to buy her train ticket, accessible coach seat, for her which cost $222.30 .  I was told that she had no luggage for the trip to Austin, Texas.  No one at the house, where she was staying, could tell me what size and shape suitcase she needed.  I went to COSTCO and purchased a Delsey suitcase for $188.55.   I chose COSTCO because they have a very good return policy and it was way too dicey that this lady would end up using this suitcase so I wanted some way to get my money back.   I then went to STAPLES and purchased shipping boxes and a tape gun for $21.45.  When I arrived at the house where she was staying, I was told that no men are allowed in.  I had to park in their driveway where I unloaded the shipping boxes and suitcase.  I asked the women who came out to help me that I wanted the suitcase box to be returned to me along with the suitcase, in case it was not used.  I also requested that the STAPLES shipping materials that was not used to also be returned to me.  A few days later, I drove over to the house to take my friend to the train station.   She was not using the suitcase that I had purchased at COSTCO because that people at the house where she stayed could not figure out how to open the TSA locks from reading the instructions included with the suitcase.  So when I arrived to pick her up, she had a very small, close to the ground, wheeled bag.  The women, at the house, also provided one single cardboard box that needed to be mailed back to her new address.   I drove my friend to the train station where we I purchased an Amtrak ticket to Texas for $222.30.  My wife had given me a bag of green grapes for my friend to take with her which turned out to be a fantastic solution for her getting food and liquid for the whole day trip.  She reported back to me that she never left her seat, on the train, for the whole trip.  She did not go to the dining car.  She only had those green grapes.  Family members picked her up at the train station when she arrived in Texas.  I returned to the home where my friend stayed to pick up the COSTCO luggage and the STAPLES items that were not used.  The ladies at this house also failed to provide the box which the COSTCO luggage was package in.  I had total right knee replacement surgery the very next day after sending my friend on the train to Texas so I was unable to attempt to return the COSTCO luggage for about three weeks.  So weeks later, I finally drove to COSTCO to see if they would reimburse me for buying the luggage.  All I had was a receipt. I was missing the box which the luggage came in.  I was missing the paperwork which the luggage provided and described how to use that piece of luggage.  It took two COSTCO employees to figure out the situation for me.  One employee knew that there was a second piece of luggage inside the large one and they had to test that it was still inside.  They used their fingers to poke through a small zipper opening but could not reach that deep inside.  Then they used a long pencil or pen to poke inside the luggage to see if they hit the inside piece of luggage and finally did hit the hidden luggage inside. Then they shook the whole luggage and felt that there was a second piece of luggage inside to confirm their first finding.  I then was given the full refund for returning this luggage!   I was expecting them to refuse this return.  I was a bit shocked at their wonderful attempts to make me happy for shopping at COSTCO.  I am indebted to their pro customer attitude.  I love shopping at COSTCO and have more reason to do so in the future.

Update:  The homeless women’s family sent me a check for $300 which completely covered my expenses.

House of Trump, House of Putin by Craig Unger Book Review

My life has changed quite a bit from having one knee totally replaced.  My day is full of icing my knee, taking medications, doing leg exercises, meeting with nurses that come to my home almost every day.  I wish to share with you a remarkable part of my life that is totally unexpected that has resulted in this knee replacement.  When I ice my knee every 40 minutes for 20 minutes, I am laying down with the ice application part of the machine attached to my knee.  I decided to use my bluetooth wireless headset and listen to an Audible book.  I had already purchased House of Trump, House of Putin by Craig Unger and decided to listen to that book.  Let me share with you my evaluation.  I really recommend that you listening to the book rather than reading it.  For me, hearing the book places it almost similar to viewing a stage play.  Hearing the book seems to add a deeper dimension, a deeper understanding of the story.  I would never read this book but rather listen to it.  The person reading the book to you, Jason Culp, does such a very good job.  The book’s contents, for me, are utterly shocking.  The book describes the history of Donald Trump and Vladimir Vladimirovich Putin and the Russian Mafia as well as other crime individuals and gangs.  At times the timeline histories are separate but then then meet when the crime characters come together. The list of criminal individuals revealed in the book seems enormous.  What these crime people do is awful and shocking.  In my mind, I keep thinking that most of this is made up because the story line, what these crime bosses do is so unreal.

This book, for me is sort of a hidden history book that explains what is taking place in the sewers of society.

Takeaways:

I have the opinion that there is a level of criminality practiced at such a high political level that the individuals involved seem to have immunity from being held responsible for their crimes.  The word Teflon is sometimes used by other individuals who also share this view.  As a result, I am gaining a view that the United States just might have separate levels of justice for the common person vs the politically connected.  The current United States examples of this possible dual standard are as follows:

  • The United States Justice Department seemingly reluctant to follow through in prosecuting Donald Trump.
  • The United States Supreme Court being unable to force Clarence Thomas to recuse himself from cases that have ties to Jinni Thomas text messages.

The Russian part of this story portrays vast deep and close to complete social political and legal self serving criminal society that fails to believe and practice any good value system.  It appears to me that the average Russian citizen is utterly complicit with the criminality because they are uncaring, ignorant, integrity deprived.  I get the picture that the common Russian goes about their simple lives with no intent or ability to try to take back Russia from the scum who currently rule their country.

I view this colossal collection of awful criminals as being on a sort of a  continuum a sort of scale of how much scum each person practices .  Putin is the worst of the worst being at the bottom and Donald Trump rides up and down slowly but overall descends closer to hurting society as much as Putin .  Each criminal scum bag has his own methods for being a terrible individual.  A common reason for their behavior is self centered interests, wishes and actions.  I have yet to understand how this type of individual came to being so selfish.

I really recommend this book.
